Terms of service.

These terms cover use of fahymas.com. Commercial terms for a specific project are set out separately in the applicable project agreement.

Two separate documents. This page is the website terms of use. It governs how you may use this website. It is not the agreement under which development work is performed — that is the project agreement or statement of work confirmed for each engagement.

Use of this website

You may browse this website and submit a project inquiry. You agree not to use the site to transmit unlawful content, to attempt to gain unauthorized access to it, or to interfere with its normal operation.

Website content and package pricing

Service descriptions and package prices on this website are provided for information. They describe the categories of work Fahymas LLC undertakes and the price that applies to a described scope. They are not an offer, a quotation, or a commitment to deliver any specific outcome, and nothing on this website forms a contract on its own.

A published package price applies only to the scope described with that package. Where your requirements fall outside that scope, the applicable fee is the one stated in the written proposal for your project.

Technology and provider names appear on this website to describe technical capability. Their use does not imply affiliation with, endorsement by, or partnership with the companies concerned. This includes Stripe, which is the payment service provider used for Fahymas LLC invoices and is not a partner, sponsor, endorser or banking partner of Fahymas LLC.

Project inquiries

Submitting an inquiry does not create a contract or reserve capacity. It starts a review. When you submit an inquiry you confirm that the information is accurate and that you are authorized to request work involving any systems, websites, accounts, data or code you reference.

Do not submit passwords, private API keys, access tokens, financial credentials or other sensitive authentication information through the form.

Basis of supply

Services are supplied for business and professional purposes. Fahymas LLC does not provide services for consumer, personal or household use.

Clients may be companies, organizations, or individuals such as founders, developers and independent professionals. In every case the services are purchased for a business or professional purpose, and both parties contract on that basis. If you are purchasing for personal or household use, Fahymas LLC is not the appropriate provider and the engagement will be declined.

Service terms

Development work is performed under a project agreement or statement of work. Deliverables, milestones, payment schedules, intellectual-property arrangements, confidentiality, acceptance criteria, change handling and any project-specific conditions are established in that agreement. Where the agreement and this page differ, the agreement governs the engagement.

Payment, cancellation and delivery

Fees and invoicing are covered in the Payment Policy. Cancellation and refunds are covered in the Project Cancellation & Refund Policy. Delivery is covered in the Service Delivery Policy. These form part of these terms.

Scope changes

Work outside an agreed scope is quoted as a change order and carried out only once agreed in writing. Fahymas LLC does not perform out-of-scope work without agreement and does not invoice for work that was not agreed.

Intellectual property

Intellectual property and ownership of deliverables transfer on the basis set out in the project agreement, on payment of the fees for those deliverables. Where fees for a deliverable have not been paid, rights in that deliverable do not transfer. Content and materials published on this website remain the property of Fahymas LLC.

Authorized and lawful use

Fahymas LLC provides development and automation services for lawful, authorized business use. Clients are responsible for ensuring they have the necessary rights and permissions for the systems, data, websites, APIs and software involved in their projects.

For data extraction, browser automation and code analysis work, Fahymas LLC requires written confirmation of ownership or authorization before work begins.

Work is declined where the intended use would involve unauthorized access, credential stuffing or harvesting, account takeover, fake-account creation, CAPTCHA or authentication bypass, security-control circumvention, detection evasion, platform abuse, spam, fraudulent automation, unauthorized account manipulation, malware, phishing, unlawful data collection, DRM bypass, license cracking, software piracy, or unauthorized reverse engineering of proprietary third-party code.

No sale of goods and no third-party funds

Fahymas LLC sells professional development services. This website does not sell products, does not operate a checkout, and does not ship anything.

Fahymas LLC does not hold, transmit, process or disburse funds belonging to any third party, and does not operate an escrow service, a marketplace, or a money transmission business.

Privacy

Information submitted through this website is handled as described in the privacy policy.

Availability and liability

This website is provided on an as-available basis. Fahymas LLC does not warrant that it will be uninterrupted or error-free, and is not liable for loss arising from reliance on general information published here. Liability in respect of a specific engagement is addressed in the applicable project agreement.

Governing law

These website terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict-of-law rules. Disputes relating to the use of this website are subject to the exclusive jurisdiction of the state and federal courts located in Kentucky.

Disputes arising from a specific engagement are governed by the governing-law and dispute-resolution provisions of the applicable project agreement or statement of work, which take precedence over this section for that engagement.

Changes

These terms may be updated. The version published on this page is the one in effect.
